What happens at this courthouse.

  1. Service and return date. A marshal serves the complaint and a lis pendens is recorded on the land records. The return date printed on the summons is the day the case officially begins at 95 Washington Street; an appearance is due by the second day after it (Practice Book § 3-2).
  2. Mediation notice. If the property is your primary residence, you may be eligible for the Foreclosure Mediation Program. Requests are filed with the clerk here and sessions are held in this building. Eligibility rules and the program's end date are set by statute and change; check the Judicial Branch program page or ask counsel.
  3. Motions and judgment. The lender moves for default and then for judgment. A judge at this courthouse decides whether the judgment is strict foreclosure (title passes to the lender on a set date, no auction) or foreclosure by sale (a committee auctions the property and the court approves the result). Which one is ordered usually turns on how much equity there is.
  4. Law days or sale. Under strict foreclosure each defendant is given a law day to redeem by paying the debt in full; if nobody redeems, title vests in the lender. Under a decree of sale, the auction is held on the property and the sale is confirmed by this court. A deficiency claim, if any, is heard here afterwards.
